These Terms & Conditions (“Terms”) apply to all sales, services, and communications involving Motion Tents Ltd (“we”, “us”, or “our”). By placing an order, making a payment, or using our products or services, you (“you”, “the customer”) agree to be bound by these Terms.

1. Orders & Contract Formation
Orders made via email, website, or other means constitute an offer and will only become binding once confirmed by Motion Tents Ltd in writing. We reserve the right to refuse or cancel any order for any reason, including availability, safety concerns, or payment issues.

2. Payment Terms
Full payment must be received before any product is shipped or any service begins.
​
We accept approved payment methods, which may vary depending on the product or service.
​
Late payments may be subject to interest under the Late Payment of Commercial Debts (Interest) Act 1998.

3. Refund Policy – 14 Days
You may request a refund within 14 days of receiving the product.
​
To qualify:
You must email us within 14 calendar days of delivery.
The product must be unused, in its original packaging, and in resalable condition.
Digital products must not be downloaded or used to qualify for a refund.
Refunds are processed within 14 days of returned products arriving. This policy aligns with the Consumer Contracts Regulations 2013.

No refunds are offered after the 14-day window.

4. Use of Products & Intellectual Property
All products and materials from Motion Tents Ltd, including branding, content, instructions, designs, and digital goods, remain the intellectual property of the company.

You may not:
Copy, redistribute, resell, or modify any of our products
Claim our branding or materials as your own
Use our products in a way that violates law or safety guidelines

All products must be used only as intended. Misuse voids any warranty or support.

5. Communication & Privacy
By placing an order or contacting us, you consent to receive relevant communications, including order confirmations, delivery details, safety instructions, or product updates.

We comply with the UK GDPR and Data Protection Act 2018 and will never share your data without consent. You may unsubscribe from marketing at any time.

6. Safety & Liability
You are responsible for:
Following all provided setup, safety, and anchoring instructions
Monitoring weather conditions and removing or securing tents in adverse conditions

Ensuring that only qualified persons handle, install, or dismantle equipment
Motion Tents Ltd is not liable for any loss, injury, or damage caused by improper use, unsafe installation, or failure to follow guidance.
We are also not liable for delays or damages resulting from events beyond our control (e.g., extreme weather, courier disruption).

7. Anchoring, Tie-Downs & Support Systems
All tents and structures must be properly secured using storm straps, tie-downs, ground anchors, and other supports as specified.
Improper anchoring includes:
Inadequate stake depth
Use on unstable or unsuitable surfaces
Omission of required tensioning systems
Use in extreme weather beyond rated limits
We accept no responsibility for accidents, structural failure, or property damage due to failure to anchor equipment properly. You are solely liable for any related claims or costs.

8. Improper Use of Products
Improper use includes (but is not limited to):
Using tents in unsafe weather
Failing to anchor correctly
Modifying structural elements
Overloading, dragging, or storing products improperly
Allowing untrained or underage persons to handle the equipment
Consequences of improper use:
Voided warranty
Refusal of future service
Full financial liability for damage or third-party claims
Possible legal action if harm or loss is caused

9. Damage, Misuse & Customer Liability (Hired or Temporary Use)
If you're using our products for a limited time (e.g., event hire):
You are responsible for any damage during the period of use
You must ensure safe setup, storage, and supervision
If the equipment is damaged, stolen, or misused, you will be charged for full repair or replacement

You agree to indemnify Motion Tents Ltd against all claims arising from injury or property damage due to misuse or poor setup.
​
10. Product Ownership, Damage & Responsibility After Sale
Once a product is sold and delivered:
Full ownership transfers to you
Motion Tents Ltd is no longer responsible for damage, misuse, or wear
You are expected to perform routine maintenance and store the product in safe, dry conditions

You must:
Inspect all components before and after use
Replace worn parts when necessary
Avoid use in conditions beyond product limitations
No refunds, exchanges, or liability apply once the product has been damaged by misuse, neglect, or poor storage.

11. Insurance & Risk
We strongly recommend you:
Obtain public liability insurance when using tents for events or business
Complete risk assessments for your site
Use proper anchoring and safety controls in all conditions
Motion Tents Ltd is not responsible for costs, claims, or legal actions arising from uninsured or unregulated use.

12. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms
We may update these Terms at any time without notice. The current version will always be published on our official communication platforms. Continued use of our products or services constitutes acceptance of any updated terms.
